Terms and Conditions

This document outlines the Terms and Conditions of the ‘Nu300 Breakthrough Program’ (the “Terms and Conditions”). All Participants shall be required to agree to this Terms and Conditions, prior to participating in the ‘Nu300 Breakthrough Program’.  

 

 

  1. DEFINITIONS

    “Organizers” shall mean the organizers of the Program;

 

“Coaches” shall mean the persons leading a particular session or activity of the Program, who may or may not be an Organizer.

 

“Participant” shall refer to a person who enrols in the Program

 

“Program” shall mean this ‘Nu300 Breakthrough Program’

 

 

  1. THE PROGRAM
    The Program shall consist of a two-day health and fitness retreat (the “Retreat”) and a ninety (90) day coaching period (“Coaching Period”).

 

  1. During the Retreat, Participants shall be entitled to attend over twenty (20) sessions on different topics related to health and fitness and avail of certain complimentary services such as:

 

  1. 1:1 strength and mobility assessment

  2. Physical examination

  3. Introduction to strength and weight training with practical exercises for all main muscle groups

  4. Development of personalized exercise and nutrition plans

  5. Practical sessions on healthy cooking and meal preparation

  6. Knowledge sessions about physiology, exercise and nutrition

 

The various services or session topics shall be subject to change and will be dependent on the availability of the service providers or Coaches.

 

  1. After the conclusion of the Retreat, Participants shall be entitled to a Coaching Period, which shall consist of the following:

 

  1. Daily access to the Coaches via a Group WhatsApp or Viber

  2. Daily direct access the Coaches via WhatsApp or Viber

  3. Weekly upload of participant pictures from their daily exercise and meal activities on a social media account

  4. Bi-weekly small group sessions (maximum of five (5) participants) with personal trainer

  5. Monthly small group sessions (maximum of five (5) participants) with a nutrition expert

 

  1. VENUES
    3.1. The venues for all the sessions during the Retreat and the Coaching Period will be within the Metro Manila area. Participants will be advised on the exact venue prior to each session.

 

  1. AGE, PHYSICAL CONDITION, AND MEDICAL BACKGROUND

 

  1.  Each Participant declares that he or she is physically fit and mentally capable to engage in exercise, fitness and diet programs as well as to participate in cooking and meal preparation events. Each Participant  must inform the Organizers, Coaches, and other related staff of any condition or risk that may have an effect on their ability to participate in the Program, prior to commencement. If a Participant has any doubt on his or her capability to undergo the Program or any session or activity of the Program, such Participant should consult with his or her physician. Participants are encouraged to consult why their physician before confirming and paying the deposit.
    4.2.  Participants should only to participate in the classes or sessions he/she is physically capable of participating in. Group classes or sessions cannot be changed or modified to accommodate an individual participant.
    4.3. All participants must be at least eighteen (18) years old at the time of enrollment in the Program.

 

 

  1. DAMAGE – PERSONAL ITEMS
    5.1. Each participant shall be responsible for his or her property. The organizers of the Program shall not responsible for the loss or theft of, or damage to, any and all personal property of each participant, whether on or off the venue premises or whether held in storage or not.

 

  1. SESSIONS AND WORKOUT
    6.1. In certain circumstances, we may need to cancel or reschedule certain sessions or activities. In case of cancellation, the organizers of the Program shall exert reasonable efforts to provide alternative sessions.
    6.2. Participants can only join sessions of the program he/she is registered in unless advised otherwise by the Organizers and/or Coaches. Registration to a session shall be on a first come, first served basis. The Organizers or Coaches may refuse to allow a Participant to register if the maximum number of Participants of a particular session is reached.
    6.3. The Coaches may recommend a participant to join certain sessions based on the participant’s objectives, injury, or fitness level, which may be different than the one the Participant registered for. However, the Participant is not obliged to follow the recommendation.
    6.4. At their sole and absolute discretion, the Organizers or Coaches may not allow a Participant to participate in a particular session, if they believe the Participant to be a major disturbance to the session or endangering himself/herself or others.
    6.5. To be allowed to participate in a session or activity, each Participant has to be at the advised venue for all sessions no later than 15 minutes before the advised time. Participants shall use their own transportation to and from all venues of the Program.
    6.6. Before the start of the Program, each Participant must familiarize himself/herself with these Terms and Conditions and the house rules of each venue.

  2. Each Participant must wear appropriate attire and shoes. For all activities in the gym, proper exercise attire and shoes should be worn. Loosely swinging or sharp jewellery should be removed before the practical exercise sessions. For all sessions in the kitchen, participants are requested to wear closed shoes.

  3. Each Participant should flag any signs of discomfort or pain immediately to any of our coaches during any session of the Program.

  4. . Each participant should not:

    1. Violate any house rules of the venues where the Retreat and Coaching sessions will be held.

    2. Join the any sessions or activity under the influence of alcohol or any other drug than can impair judgement and/or physical performance.

    3. Use recording devices of any kind (including mobile phones / smart phones) to record program sessions or parts thereof. The use of mobile phones is only permitted for picture taking if explicitly advised and allowed by the coaches.

    4.  If the guest violates any of these Terms and Conditions, the Organizers or Coaches may not allow a participant to participate in a particular session. At their sole and absolute discretion, the Organizers may cancel or suspend a Participant’s participation in the Program. In all cases, Participant shall not be allowed any refund of the Program fee.
      6.10. Program sessions will be held as announced by the Organizers or Coaches. If a  Participant misses any session, it may affect his/her expected results. Participants shall not be refunded or be allowed to reschedule missed sessions.

 

  1. TRANSFER OF PROGRAM TO ANOTHER PERSON
    7.1. Participants are not allowed to give, sell, or transfer their enrollment in the Program, or a part thereof to any person.

     

  2. LIMITATION OF LIABILITY

    1. Participation in the program involves physical activity, which may expose the Participants to the risk of personal injury. In participating in the Program, Participants assume all risks arising directly or indirectly from his/her participation in the program regardless of how they might arise, including without limitation risks relating to (i) any theft, loss or disappearance of property, (ii) bodily injury (fatal or non-fatal) and (iii) property damage. We advise Participants to not to participate in the program if pregnant, or with existing medical conditions without first consulting your doctor.

    2.  Most Coaches are separate and independent from the Organizers. In selecting the Coaches for a session, the Organizers believe that they are appropriately qualified to conduct the Particular session. Unless the Organizers have been grossly negligent, the Organizers disclaims any responsibility or liability for the acts of the Coaches during the Program.   

    3. Where the liability of the Organizers or Coaches is not expressly excluded under these Terms and Conditions or under any applicable law, subject to satisfactory proof, the liability of the Organizers or Coaches to each Participant for any event giving rise to a claim in contract (including indemnities), tort (including negligence) or otherwise whosoever and whatever the cause thereof, arising by reason of or in connection with the Program shall be limited to a maximum amount of the fees paid by the Participant for the Program.

 

  1. PAYMENT
    9.1. Accepted payment methods are PayPal and Bank transfer to:
    DBS Singapore, Swift Code: DBSSSGSG, Bank Code: 7171, Branch Code: 109, Account No.: 1090039963, Type: Current Account.

    1.  A PHP 15,000 deposit is requested per program/per person to ensure a slot in the Program. This PHP 15,000 deposit is considered as a security deposit for placing the booking. Should the Participant cancel his/her enrolment in the Program prior to 14 days before the start of the Program, the Organizers, in their sole discretion may reimburse the deposit in full or parts to the Participant.
      9.3. Participants shall not be allowed to participate in the Program or any part thereof without paying the full Program amount due.
      9.4. Participants may pay by instalments, or the total amount of the balance due, before the advised due date, using our PayPal service or money transfer (applicable bank or service rules and fees apply). In all cases, the guest has to settle the total amount of the balance upon “Retreat start day” at the latest.
      9.5. All transfer fees and expenses in connection with the payment shall be the responsibility of the Participant.

 

  1. CANCELLATION / TERMINATION
    10.1. All cancellation requests for any reason less than 14 days before start of the Program will resort in the PHP 15,000 deposit forfeiture of all the deposit and/or other payments made.

10.2. Organizers reserve the right to terminate a participation of a Participant in the Program for any violation of any of these Terms and Conditions. Any termination due to the violation of any of these terms and consideration will result in the forfeiture of any the deposit and/or other payments made.

 

  1. INSURANCE
    11.1. As our programs include physical exercise, diet regimes and cooking activities, each Participant is required to purchase their own personal medical and accidental insurance before they enrol in the Program.

 

  1.  DATA PRIVACY

    1.  Each Participant authorizes and consents to the collection, processing, and use by the Organizers and Coaches, of his or her personal information, which includes, each Participant’s name, telephone number, email, address and certain medical and physical data from the blood work or the initial physical assessment for the following purposes: (i) provision of any service or product relating to his or her participation in the Program; (ii) requesting feedback through the completion of customer satisfaction surveys; and (iii) sending marketing materials and promotions about the Organizer’s products, services, and special offers.

    2. Each Participant further authorizes and consents to the transfer, disclosure, sharing and communication of personal information collected by the Organizers to third-party personal information controllers or processors, and other data processors or sub-contractors for foregoing purposes or any other purposes that will be specified that prior to sharing of such information or data.

    3. Each Participant acknowledges and consents to the retention by Organizers of the personal information collected for as long as necessary to fulfil the purpose for which it was collected or for as long as it is permitted or required by law.

12.4. Each Participant confirms that he or she is aware of his or her rights under the relevant privacy laws and regulations, which include the right to withdraw the consents herein provided and the right to access, rectify, erase, and block his or her information. Each Participant shall immediately notify the Organizers of any decision to exercise any of these rights.

 
 

13. CHANGES TO SERVICES & TERMS AND CONDITIONS
13.1. the Organizers reserve the right to make changes to services and Terms and Conditions at any time.

 

14. SEVERANCE
14.1 If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Terms and Conditions and the remainder of the provision in question shall not be affected.
